Srinagar, (KMW News): While Commenting on the issue of the illegal Structure raised in gross violation of the city town plan adjacent to the boundary wall of ANC President Begum Khalida Shah by her cousin Omar Khalil Nedou, I have a dual purpose in taking this matter to its logical conclusion under law. The first being to safeguard our personal interests and legally secured rights with regard to our family privacy and easement rights, and secondly the equally important reason to expose the functioning of the Public Bodies in our state which work under fear and intimidation of the powers that be. This in turn will hopefully set a precedent whereby all Public Bodies will be able to discharge their Lawful duties without interference from any quarter while strictly adhering to the laws of the land, said ANC Senior Vice President Mr. Muzzafar Shah in a press release issued today.
Mr. Muzzafar Shah stated that the stark reality is that he personally visited the Municipal Commissioner in his office at 6. Pm on 31st May 2013 after Begum Khalida Shah had repeatedly informed him on phone about the illegal structure being raised without proper permission and apprised him in detail about their private rights being adversely affected and jeopardized, basic requirement of Law being totally ignored and impressed upon him and a team of officials present their to stop this illegality being done under their vary nose in the green belt area of Srinagar Municipality. Though a full demolition squad had been dispatched earlier to this spot, which surprisingly had returned without taking any action best know to the Commissioner Municipality or any power that be.
Mr. Shah said that the Municipal Commissioner visited Begum Khalida residence late in the evening around 9 pm, took photographs of the illegal structure on his mobile phone and made observations that the structure raised was not conforming to the laws of the land and as such required action would be taken forthwith. He impressed Begum Khalida Shah to have full faith in him and to leave this matter for him to resolve. What was the sanctity of the reply given by the Municipal authorities to Begum Khalida Shah’s open Letter to the Chief Minister with a copy to the Municipal Commissioner, wherein he vehemently states of not receiving any written complaint to this effect, once the Municipal Commissioner himself was a witness to the entire process, asked Mr. Muzzafar Shah.
Mr. Shah further stated that there is no truth that the two parties had agreed as stated by the Municipal authorities of having arrived at an agreement to allow the structure to be raised by keeping a 7 feet fire gap. No official till date has met with Begum Khalida Shah, therefore this comment in writing and published in the press by Municipal Authorities is a total lie, he said.
For the information of the Municipal Commissioner , let it be known to him that he is not competent nor authorized to sanction any permission in favour of any person including Mr. Omar Khalil Nedou, nor can he regularize any such illegal construction as the law applicable in this regard does not recognize or sanction such acts, Mr. Muzzafar Shah Said.
