Aitzaz terms PM Gilani’s stance flawed on COAS, DG ISI replies

ISLAMABAD: Barrister Aitzaz Ahsan on Wednesday termed the stance of Prime Minister Yusuf Raza Gilani flawed over the manner in which Army Chief and DG ISI submitted their replies to the Supreme Court in memo case.

Aitzaz Ahsan, who is all set to defend Prime Minister Yusuf Raza Gilani in contempt of court case on Thursday, was speaking in Geo News programme ‘Capital Talk’ hosted by senior anchor Hamid Mir.

In connection with the implementation of the NRO verdict of the Supreme Court, Aitzaz Ahsan said President Zardari enjoyed immunity in criminal cases both in Pakistan as well as Switzerland.

He said the court had a responsibility not to insist on writing a letter that would eventually be dismissed in Switzerland.

The grounds on which the Swiss authorities will reject it will be that the President has immunity in Switzerland too, he added.

To a question, Aitzaz said it is not for him to decide whether the case would be over if the letter was written.

When asked whether the Prime Minister would be declared ineligible in case the Supreme Court could not be convinced, Aitzaz Ahsan said the Supreme Court would send its decision to the Speaker National Assembly who will then forward it to the Election Commission of Pakistan (ECP).

“The ECP will then make a final decision whether the Prime Minister is guilty or otherwise after holding its own hearing of the case.”

The Supreme Court on January 16 issued a show cause notice to the Prime Minister on contempt of court for not taking any action with regard to the implementation of the apex court’s verdict on NRO. (KMW News)
