Srinagar: Taking cognizance of the Public Interest Litigation (PIL) filed by Doctors Association of Kashmir (DAK) seeking independent probe into the supply of spurious drugs to hospitals in Kashmir, High Court Tuesday issued notice to the state government, former Health Minister, Central Purchasing Committee members and M S Lifeline Pharmaco Surgical Ltd and directed all the parties whosoever are affiliated with the investigation to submit a latest status report on the investigations conducted in this regard by Wednesday today.
The counsel for DAK, Advocate Bhat Fayaz Ahmed told that the PIL submitted on April 12 was listed before the Division Bench comprised of Justice Mansoor Ahmed Mir and Justice Ali Mohammad Magray today.
The Court took strong cognizance of the matter and directed the respondents to take Honorable Court into confidence in order to ensure that the menace of spurious drugs is curbed within the State.
The Court accordingly directed the respondents to file a status report by tomorrow (May 01) and the status of the enquiry in a case registered by the Crime Branch.
The counsel for DAK, Advocate Fayaz Ahmed apprised the Court about the apprehensions that the respondents might destroy samples on which the Court directed Senior Additional Advocate General Javid Ahmed Kawoosa to ensure that the respondents preserve the samples.
Advocate Fayaz Ahmed told that the Court has dispatched notices to all the parties including former Health Minister, Sham Lal Sharma. “Notices have been dispatched and the case has been listed for tomorrow once again.
Pertinently, DAK president Dr Nisar-ul-Hassan had filed the PIL through his counsel Advocate Bhat Fayaz Ahmed seeking a thorough and independent probe into the drug scandal filed the PIL. The PIL had been submitted against the State of Jammu and Kashmir mentioning the names of former Health Minister, Secretary Health, Director Health Services, Controller Drug and Food Organization, CPC officials and others related to the matter.
